IF YOU DISAGREE WITH THESE SERVICE TERMS, DO NOT CREATE AN ACCOUNT OR UTILIZE THE SERVICE. YOU HEREBY GRANT THE AUTHORITY TO REPRESENTATIVE PARTIES THAT CLICK THE "I ACCEPT" BUTTON OR OTHERWISE DEMONSTRATE ACCEPTANCE OF THESE SERVICE TERMS ON YOUR BEHALF.
ARBITRATION NOTICE: BY ACCEPTING THESE SERVICE TERMS, YOU CONCUR THAT DISPUTES BETWEEN YOU AND US OR BETWEEN YOU AND THE MEDICAL GROUPS OR PROVIDERS ARISING OUT OF OR RELATED TO THESE SERVICE TERMS OR THE SERVICE WILL BE RESOLVED THROUGH BINDING, INDIVIDUAL ARBITRATION, AND YOU FORFEIT YOUR RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR COLLECTIVE ARBITRATION, AS FURTHER DESCRIBED HEREIN.

1. Introduction
Now Health Group Parent LLC ("Now Health Group," "we," or "us") owns and operates this website situated at https://allmednow.com/ as well as the AllMed Now mobile application (collectively referred to as the "Platform"). Now Health Group offers the Platform and associated booking and membership services (the "Service") and connects individuals with local healthcare providers in their vicinity. Your access to and utilization of the Platform and the Service are regulated by these Service Terms ("Service Terms" or "Agreement").
Please examine this Agreement thoroughly as it establishes the essential conditions that you should be aware of concerning the Service. In this Agreement, the terms "you" and "your" pertain to the individual utilizing the Service, or in the event of usage of the Service by or on behalf of a minor, "you" and "your" refer to and encompass (i) the parent or legal guardian granting consent for the minor's use of the Service or utilizing the Service on behalf of the minor, and (ii) the minor for whom consent is being granted or on whose behalf the Service is being employed. For more details concerning the utilization of the Service by minors and the pertinent limitations on such utilization, please refer to the "Limited Usage and Availability" Section of this Agreement.
Notwithstanding the foregoing, the Service is not intended for individuals under the age of thirteen (13), and individuals under the age of thirteen (13) are precluded from using any or all portions of the Service or entering into this Agreement, even if a parent or legal guardian is willing to provide consent for the Service's use or this Agreement. Should you be a parent or legal guardian of an individual under the age of eighteen (18) whom you believe has used the Service without your consent, kindly get in touch with us at info@allmednow.com.
2. Acceptance of Service Terms
Your access to and use of the Service are contingent upon this Agreement, as well as all applicable laws and regulations. If you decline to accept and agree to be bound by this Agreement in its entirety, you are expressly prohibited from visiting, accessing, registering with, and/or utilizing the Service, except as necessitated for the review of this Agreement. The Service is continually advancing, and we reserve the prerogative to amend or eliminate any part of this Agreement or the Service at our sole discretion at any time and without prior notice to you. Any alterations to this Agreement take effect upon publication on this page. In the event of disagreement with this Agreement or any terms or provisions herein, your sole recourse is to cease your use of the Service. Your continued utilization subsequent to an alteration to this Agreement being published signifies your acceptance of this Agreement as modified by said changes.
3. Your Relationship with Us: Medical Disclaimer Regarding Now Health Group Services
Now Health Group solely administers the Platform and booking service and engages with medical entities and medical providers to furnish medical services. However, Now Health Group does not operate as a medical entity or provider in and of itself and bears no responsibility for the delivery of medical services.
We provide Users with access to services from third-party medical providers, pharmacies, or other vendors through our Service. Our Service facilitates contact with medical groups and medical providers throughout the United States and around the world who possess the necessary licenses in the relevant state or jurisdiction and offer healthcare services (referred to as the "Medical Groups"). The Medical Groups employ or contract with physicians and allied health professionals, including nurses, physician assistants, and others, who provide specific healthcare services permitted in their local state or jurisdiction (the "Providers"). We also enable access to prescription fulfillment services provided by pharmacies (the "Pharmacies") and laboratory services offered by laboratories (the "Labs"). By accepting this Agreement, you acknowledge and consent that any services you receive from the Medical Groups, Providers, Labs, and Pharmacies that are arranged via the Platform are also subject to this Agreement, and that the Medical Groups, Providers, Labs, and Pharmacies are third-party beneficiaries under this Agreement. Furthermore, you agree that Now Health Group is not liable for the provision of any medical services, and you release Now Health Group and its owners, officers, members, managers, employees, and agents from any and all liability related to the provision of any medical services.
We exclusively schedule your requested service(s) and bill you on behalf of the Medical Groups, Providers, Pharmacies, and Labs. We do not provide medical care services. Our booking service does not engage in medical practice, and we are not accountable for delivering healthcare services or making determinations concerning your care.
We do not oversee or interfere with the practice of medicine by the Medical Groups or any Providers, each of whom is solely responsible for overseeing the medical care and/or treatment they dispense to you. By accepting this Agreement, you acknowledge and concur that Now Health Group is neither a medical corporation nor a healthcare provider, and that by using the Service, you are not entering into a doctor-patient or any other healthcare provider-patient relationship with Now Health Group. By utilizing the Service, however, you may be entering into a doctor-patient or other healthcare provider-patient relationship with a Medical Group and/or one or more Providers. Additionally, we do not oversee or interfere with any professional services provided by the Labs and Pharmacies, each of which is solely responsible for their provision of professional services.
Your interactions with Medical Groups and Providers are NOT intended to supplant your relationships with your regular in-person healthcare practitioner(s) and primary care providers.
By accepting this Agreement, you acknowledge and concur that the Medical Group and/or Providers may send you messages, reports, and emails through the Service regarding your diagnosis and/or treatment. You understand and agree that Now Health Group is not responsible for the security or privacy of communication services you employ to receive the aforementioned messages, reports, and emails transmitted through the Service. Moreover, you understand and agree that it is solely your responsibility to monitor and respond to these messages, reports, and emails, and that neither Now Health Group nor the Medical Group nor any Provider will be held responsible in any manner, and you will not hold Now Health Group, the Medical Group, or any Provider accountable for any loss, injury, or claims of any nature stemming from your failure to read or respond to these messages or from your failure to adhere to any treatment recommendations or instructions from the Medical Group or your Provider(s).
While you are not establishing a doctor-patient or other healthcare provider-patient relationship with Now Health Group, by employing the Service and Platform, you are establishing a direct customer relationship with Now Health Group to utilize the Service, including any acquisition of a membership directly sold to you by Now Health Group through the Service. In connection with such a relationship, you may furnish us or cause to be furnished on your behalf with personal information, including health information, subject to our utilization in accordance with our Privacy Policy. Please refer to the "Privacy Policy" section and the "Protected Information" section below for additional details.
4. Non-Acceptance of Insurance; Notification of Financial Responsibility for Services
Mobil Medical and the Medical Groups do not participate in commercial health insurance plans, are not affiliated with any commercial health insurance plans, and are not registered with, nor are they providers within, any federal or state healthcare programs (e.g., Medicare, Medicaid) for the provision of healthcare services or supplies. Consequently, neither you nor Now Health Group or the Medical Groups can expect to receive payment from insurance or such programs for the services or products provided to you by Now Health Group or the Medical Groups. Additionally, to the extent that any of the Labs, Pharmacies, or Providers may be enrolled in federal or state healthcare programs, the manner in which the services and products are provided or made available through the Service generally precludes them from being eligible for coverage under these programs. By electing to use the Service, you are explicitly choosing to acquire products and services on a cash basis outside of any commercial health insurance plan or federal or state healthcare program. Therefore, you are entirely responsible for the expenses associated with any service or product provided to you.
By consenting to use the Service, you acknowledge and agree that (1) you are expressly opting to obtain products and services on a cash basis outside of any commercial health insurance plan or federal or state healthcare program, and you bear sole financial responsibility for all services or products provided to you by or through the Service, and (2) neither you nor Now Health Group, the Labs, the Pharmacies, the Medical Groups, or the Providers will file a claim for reimbursement with any federal or state healthcare program for the costs of the services and products provided to you through the Service.
5. Subscriptions and Membership Services
Certain products and services available for purchase through the Service, including our Monthly Memberships, necessitate the purchase of the product or service on an automatically renewing subscription basis ("Subscription Services"). For Subscription Services, your designated payment method will be automatically charged at specified intervals as outlined for that subscription during the checkout process until you cancel your subscription. You have the option to cancel a subscription at any time before the cancellation deadline, as indicated to you at the time of purchasing a Subscription Service. Regarding our Monthly Memberships, your designated payment method will be automatically charged on a monthly basis until you decide to cancel your membership. We mandate a three-month minimum period prior to canceling Monthly Memberships. You can cancel a subscription up to forty-eight (48) hours prior to the forthcoming renewal processing date of your subscription through the Service by utilizing our contact form found here: https://allmednow.com/contact-us/.
Please be aware that our Monthly Memberships do not encompass travel costs or any additional service fees.
In an effort to streamline the user experience through the Service, you will only see and be obliged to pay a single "total" subscription fee. However, if a subscription product you purchase, such as Peptide or another, mandates a consultation with a Provider and encompasses a prescription product that you fill through one of the Pharmacies, then the total amount you pay encompasses the charges for using the Service, in addition to the fees charged by the Pharmacy for the prescription drug and the fees charged by the Medical Group for the services provided by the Provider, as applicable. These amounts are collected on behalf of and remitted to the Pharmacies and Medical Groups, respectively.
6. Prescription Products
Certain products available through the Platform necessitate a valid prescription issued by a licensed healthcare Provider. You will be unable to acquire a prescription product unless you have undergone a consultation with one of the Providers, the Provider has determined that the prescription product is suitable for you, and the Provider has issued a prescription.
If a Provider concludes that a prescription product is suitable for you and provides a prescription, you will receive information on the options for obtaining the prescription. Some prescriptions can be filled through one of the Pharmacies via the Platform (or you may opt to fill the prescription at a pharmacy of your choice). Prescriptions fulfilled by the Pharmacies do not employ child-resistant packaging, and prescription products will not be dispensed in child-resistant containers. You are required to keep them out of the reach of children.
Should you complete a consultation with a Provider and fill a prescription through one of the Pharmacies, the prescription product is shipped to you by the respective Pharmacy, and the expenses associated with the prescription are incorporated into the total amount charged to you by the Service, as delineated in the "Subscriptions and Membership Services" section above. If you decide to fill a prescription with a pharmacy other than the Pharmacies, the Service will transmit the prescription to your chosen pharmacy, but you will be responsible for collecting or otherwise obtaining the prescription product and directly remitting payment to the pharmacy for the cost of the prescription product. By providing us consent, you authorize us to transmit and disclose to the pharmacy of your choice all information provided by you, health records, and any other pertinent healthcare and personal information (such as your name, location, and demographic details) to facilitate your receipt of pharmacy services.
Prescription products accessible through the Platform are classified as "Third-Party Goods and Services," as described in the Third-Party Goods and Services section of this Agreement.
7. Laboratory Products and Services
Certain laboratory products and services offered through the Platform, including at-home testing kits and services, necessitate a valid prescription or order issued by a licensed healthcare provider. You will not be able to obtain such laboratory services unless you have undergone a consultation with one of the Providers, the Provider has determined that the laboratory product and/or service is suitable for you, and the Provider has prescribed or ordered the laboratory product and/or service.
At present, laboratory products and services available through the Platform can exclusively be ordered and fulfilled through the Labs and are not accessible through local laboratories. If you receive laboratory products and/or services from a Lab via the Platform, the relevant testing materials are shipped to you by the respective Lab, and the costs associated with the laboratory products and services are included in the total amount charged to you by the Service.
Upon any required review and approval by a healthcare Provider, we will dispatch or arrange for the delivery of the requested test kit to your address. You are obligated to adhere to the instructions provided with the kit, which involve registering your kit, collecting the pertinent biological sample(s), completing any mandatory documentation, and returning both the biological samples and documentation to the applicable laboratory responsible for conducting the testing. Failure to adhere to these instructions may result in the non-processing of your samples by the Lab.
Laboratory products and services available through the Platform are categorized as "Third-Party Goods and Services," as explained in the Third-Party Goods and Services section of this Agreement.
8. Sales Terms and Payment
You agree to make all necessary payments for requested services according to the fees and payment terms provided to you when conducting transactions. Prices are subject to change at our discretion. When you engage in transactions, you will be prompted to provide payment details, such as credit card information and any applicable promotional codes. By entering your payment information and submitting your request, you authorize us, our affiliates, or our third-party payment processors to charge the specified amount, including recurring fees related to Subscription Services.
All monetary transactions, including credit card, debit card, and other payments, on or through the Service are processed via an online payment processing application(s) accessible through the Service. This payment processing application(s) is provided by a third-party online payment processing vendor of Now Health Group.
In case your credit card expires or our third-party payment processors cannot process your payment, you may receive a notice to provide an alternative payment method. We and the Medical Groups, Providers, Pharmacies, or Labs are not obligated to provide any services until full payment is received and/or verified. You are responsible for ensuring the accuracy and currency of your payment information (such as credit card number and billing address) at all times.
Only valid payment methods accepted by us can be used for purchases through the Service. You represent and warrant that you are authorized to use your designated payment method. You grant us permission to charge your designated payment method for the total order amount (including applicable taxes and shipping and handling charges). If your designated payment method is declined, we will attempt to process the charge until the transaction is approved. We and our third-party payment service providers may request and receive updated payment card information from your payment card issuer, such as updated card numbers and expiration dates when your credit card expires. If we receive such updated information, you agree that we may update your account information and use this updated information to process payments for future purchases and applicable subscription charges (including taxes and shipping and handling charges). You may have the right to opt out of providing vendors and third-party payment service providers with updated card information through your payment card issuer. If you wish to opt out, you should contact your card issuer. We are not responsible for any fees or charges imposed by your bank or payment card issuer. If your bank or card issuer reverses a charge to your payment card, we may bill your account directly and seek payment through an alternative method, including sending a statement by mail.
All products offered for sale by Now Health Group are subject to availability, and we reserve the right to limit quantities or reject all or part of an order without prior notice. In case of an error, we reserve the right to correct the error, adjust your order accordingly (including charging the correct price), or cancel the order and refund any amount charged. Product prices are subject to change at any time. You are responsible for any applicable sales, use, duty, customs, or other government taxes, levies, or fees ("Taxes") related to your purchase of products or services through our Service. We will collect applicable Taxes if required by law. An estimate of the Taxes we collect may be presented at checkout unless we expressly state that a price includes Taxes. Actual Taxes charged may vary from the amount shown at checkout due to differences in processor programs and changes in tax rates. We are not obligated to collect Taxes in all states, and if we do not collect such Taxes, you may be responsible for reporting and paying them directly.
If any products in your order are unavailable, we will only charge you for the products included in the shipment, along with any associated taxes and charges. You may be required to provide certain transaction-relevant information, such as payment card number, expiration date, billing address, shipping address, phone number, and email address, in connection with any purchase you make through the Service. By submitting this information, you grant Now Health Group the irrevocable, unrestricted, worldwide, and perpetual right to provide such information (including any updates we receive) to third parties (e.g., payment processing companies, buyers on the Service, sellers on the Service) to facilitate the transaction.
You agree to pay any shipping and handling charges, if applicable, as indicated at the time of purchase. We reserve the right to modify, adjust, add, or remove shipping and handling charges at our discretion, with notice of such changes provided to you before completing your purchase. Any delivery dates or times provided during the checkout process are approximate and not guaranteed. Unless explicitly stated in writing through the Service, the risk of loss or damage to a product passes to you upon delivery to our designated carrier.
We reserve the right to address user issues and concerns on a case-by-case basis. We retain the sole discretion to resolve customer issues and concerns based on the facts and circumstances of each user.
EXCEPT AS OTHERWISE STATED IN ANY RETURN OR REFUND POLICY PROVIDED TO YOU THROUGH THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT, DUE TO THE NATURE OF THE PRODUCTS AND SERVICES OFFERED THROUGH THE SERVICE, ANY FEES AND CHARGES ARE NON-REFUNDABLE, IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT, INCLUDING ANY UNAUTHORIZED CHARGES.
9. Limited Use and Availability
Our Service is currently only available to individuals located in states and countries where we offer the Service, who are at least eighteen (18) years of age or the age of majority in their jurisdiction, if higher than eighteen (18), and who have accepted this Agreement. Individuals aged between 13 and 18 may use the Service in states and countries where it is available if they have obtained consent from a parent or legal guardian in accordance with the requirements outlined in this Agreement and the Service. By using the Service, you represent and warrant that you meet these age and consent requirements, will comply with all applicable laws, and will use the Service for lawful purposes. Our Service is subject to state and local regulations, which may change over time due to evolving regulatory requirements.
Certain products available through the Service may be subject to additional age restrictions, and not all products or services are available to all age groups.
In certain cases, the Service may not be suitable for providing information, communication, or medical care and treatment from a healthcare provider. For example, some medical conditions may require in-person treatment or a healthcare provider other than your current provider. Your healthcare provider may also determine that your condition warrants an in-person office visit or is not suitable for treatment through the Service. In such situations, you will be notified that the Service cannot be used for your specific issue, along with guidance on next steps.
10. Consent to Use of Telehealth Services
Telehealth involves providing healthcare services electronically, using technology to connect healthcare providers and patients who are not in the same physical location. While telehealth services offer potential benefits, they also come with certain risks. Telehealth services cannot replace in-person care in all circumstances. To use the Service, you will need to review and accept an informed consent for medical treatment and telehealth use (the "Patient Consent"), provided to you through the Service. You acknowledge that Now Health Group is a third-party beneficiary of the Patient Consent and has the right to enforce it against you.
11. Obligation to Provide Information, Access, and Connectivity
You are responsible for maintaining the necessary software and hardware capabilities, including a computer or mobile device with a video camera and internet access, to use the Service. You must cover any associated fees, including internet or mobile charges, incurred while accessing the Service. Additionally, you are responsible for providing accurate and complete information in any forms or communications submitted through the Service. We may change the access configuration, including software, hardware, or other requirements, without prior notice.
12. Privacy Policy
We value the confidentiality and privacy of your personal information. Please refer to our Privacy Policy for details on how we collect, use, and disclose your personal information.
13. Protected Health Information
While you create an account with Now Health Group, you provide information like your name, email address, shipping address, and phone number, which we collect, use, and disclose in accordance with our Privacy Policy. This information is not considered "health" or "medical" information.
However, when using certain parts of the Service, you may provide medical information protected by applicable laws. Now Health Group is not considered a "covered entity" under HIPAA, and the application of HIPAA may vary for the Labs, Pharmacies, or Medical Groups. We may be considered a "business associate" of Labs, Pharmacies, or Medical Groups in some cases. The Labs, Pharmacies, and Medical Groups have their own Notice of Privacy Practices describing how they use and disclose protected health information (PHI). By using the Service, you acknowledge receipt of the Notice of Privacy Practices from your Medical Group and Provider(s).
Information provided to Now Health Group, not intended exclusively for diagnosis and treatment by the Medical Groups and Providers or prescription fulfillment by the Pharmacies or laboratory services by the Labs, is not considered Protected Information under applicable laws and is subject to our Privacy Policy.
14. Registration; User Accounts, Passwords, and Security
You are required to register and set up an account to access the Service. The Service is available to registered Users with usernames and passwords. You must provide accurate and up-to-date information about yourself. Failure to do so may result in the suspension or termination of your account. You must promptly notify Now Health Group of any unauthorized use of your username, password, or security breach. You must keep your username and password confidential and log out when not in use.
15. Use and Ownership of the Service
The Service and its content are protected by copyright laws worldwide. Subject to this Agreement, Now Health Group grants you a limited, non-transferable, revocable license to access and use the Service for personal purposes. All rights to the Service and content are reserved by Now Health Group. You acknowledge that Now Health Group and its suppliers own all rights, titles, and interests in the Service. You may not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices associated with the Service.
The "AllMed Now" name, related graphics, logos, service marks, and trade names used with the Service are Now Health Group's trademarks and may not be used without permission. Other trademarks, service marks, and trade names may appear on or in connection with the Service and are the property of their respective owners.
16. License to Information Submitted via the Service
By using the Service, you agree that any information you transmit to Now Health Group, whether through direct entry, submission, email, or other means (collectively referred to as "Submissions"), will be treated as non-confidential and non-proprietary. You grant Now Health Group a broad license to use, distribute, modify, adapt, publicly perform, and publicly display these Submissions for the purpose of operating and providing the Service. This license is perpetual, irrevocable, worldwide, royalty-free, non-exclusive, and fully sublicensable.
You warrant that you have the necessary rights to grant this license for the Submissions you provide. Now Health Group reserves the right to edit, duplicate, or alter the Submissions as it deems necessary or desirable. You also waive any moral rights you may have in the Submissions.
If your Submissions contain Protected Information, Now Health Group's rights regarding the use or disclosure of such information will be limited as required by applicable law.
17. Prohibited Use
You are prohibited from using the Service for unlawful, unauthorized, fraudulent, malicious, or disruptive purposes. This includes actions that could damage or impair the Service, interfere with other users' enjoyment of the Service, gain unauthorized access to systems, data, or information, and more. You also agree not to upload or transmit inappropriate content, engage in impersonation, distribute viruses or malware, engage in unauthorized advertising or solicitation, or violate any applicable laws.
Now Health Group reserves the right to take appropriate actions, including suspending or terminating your access to the Service, in response to violations of these rules.
18. Third-Party Goods and Services
The Service may offer products or services from third-party providers, including Labs, Pharmacies, Medical Groups, and Providers. Your interactions with these third parties and your use of their products or services are solely between you and them. Now Health Group is not responsible for any issues or disputes arising from these interactions.
Now Health Group Owners and Personnel may have financial interests in these third-party providers, and you should exercise caution and conduct your own investigations before engaging with them.
19. Termination
Now Health Group has the right to terminate a user's access to the Service at any time, with or without notice, for various reasons, including violations of this Agreement or the discontinuation of the Service. Certain provisions of this Agreement will continue to apply even after termination.
20. Disclaimers
This section states that the Service is provided "as is" and "as available," and Now Health Group disclaims all warranties and conditions, including implied warranties of merchantability, non-infringement, and fitness for a particular purpose. It clarifies that users access and use the Service voluntarily and at their own risk. It also mentions that Now Health Group does not guarantee the accuracy, completeness, or uninterrupted operation of the Service.
21. Limitation of Liability
Now Health Group's liability is limited to the fullest extent permitted by applicable law. In no event shall Now Health Group be liable for certain types of damages, including indirect, special, or consequential damages. The maximum liability of Now Health Group is limited to $1,000. Some jurisdictions may not allow the exclusion of certain warranties or limitations on liability, so this limitation may not apply in those cases.
22. Indemnification
Users agree to defend, indemnify, and hold Now Health Group and other parties harmless from claims, damages, and expenses arising from their use of the Service, violation of this Agreement, or infringement of others' rights.
23. Notices
Now Health Group may provide notices to users via email, posted notices on the Service, or regular mail.
24. Changes to Terms of Service and Services
Now Health Group reserves the right to change these Terms of Service and the Service itself at any time. Users are encouraged to check for updates and are considered to accept changes by continuing to use the Service.
25. Electronic Communications
Users agree to receive communications from Now Health Group electronically, such as emails or SMS messages. Electronic communications are considered valid and received on the date of transmission.
